Terms of service (TOS)

1. Acceptance of terms

Access to and use of the WalkAboutWild website implies full and complete acceptance of these TOS. Registering on the website constitutes an electronic signature of these conditions.

2. Code of conduct (user-generated content)

Users are solely responsible for the content (texts, photos, GPX) they post online.

Non-exhaustive list of what is strictly prohibited from publishing:

  • Hateful, defamatory, racist or pornographic content.
  • Photos you do not own the rights to.
  • GPX tracks crossing prohibited private properties or protected natural areas (strict nature reserves) without mentioning the restrictions.

Moderation: the publisher reserves the right to delete without notice any content not complying with these rules, and to ban offending users.

3. Intellectual Property and License

All elements making up the application (including texts, graphics, images, software, logos and their layout) are the exclusive property of the site publisher, with the exception of trademarks, logos or content belonging to third-party companies or authors.

Content protection

Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of these various elements is strictly prohibited without the express written consent of the publisher. Such representation or reproduction, by any means whatsoever, constitutes an infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.

Distinctive signs

The name "WalkAboutWild", as well as associated logos, are protected signs. Any unauthorized use of these signs may result in legal proceedings.

User content

The user remains the exclusive owner of the intellectual property rights attached to the content they own and publish on the platform (including photos, texts, route files). The user grants WalkAboutWild a non-exclusive, free, worldwide and transferable license. This license authorizes WalkAboutWild to host, store, reproduce, modify (for technical formatting purposes), communicate to the public and display this content, solely for the purpose of operating, improving and promoting the service. The user guarantees that they hold all necessary rights over the content they publish. If content does not belong to them, they must credit the author in accordance with the license associated with that content.

4. Liability related to Treks, GPX, and Plants/Mushrooms (Disclaimer)

Nature of information

Information on routes (GPX tracks, descriptions, difficulty levels) is provided by the community for informational purposes only. Mountain environments are constantly changing (weather, rockfalls, terrain modification). Descriptive sheets for plants/mushrooms are provided for informational purposes by WalkAboutWild and do not replace rigorous identification in the field by a professional.

No warranty

WalkAboutWild does not guarantee the accuracy, reliability or completeness of the data provided. A GPX track may contain technical errors.

Limitation of liability

The site publisher cannot be held responsible for incidents or accidents (falls, getting lost, injuries, poisoning) occurring during the use of a route description, a GPX track, or a plant descriptive sheet found on the site.

  • The user is solely responsible for their own safety.
  • The user must be proficient in navigation and have adequate equipment before embarking on a route.
  • The maps available on the application are provided for informational purposes only and in no way replace an up-to-date official map (e.g.: IGN) or trail markings on the ground.
  • Errors in identifying plants/mushrooms can be dangerous, even fatal. It is the user's responsibility to verify information and exercise caution when using the site.

5. Data protection

Database producer rights

In accordance with articles L.341-1 et seq. of the French Intellectual Property Code, WalkAboutWild is recognized as the producer of the database constituted by all the treks, readings and structured information on the platform. As such, the platform is protected against unauthorized extraction or reuse of its content.

Prohibition of extraction

To protect the community's work and the integrity of the platform, it is strictly prohibited for any user or third party to:

  • Extract, by permanent or temporary transfer, all or a qualitatively or quantitatively substantial part of the content of WalkAboutWild's database to another medium, by any means and in any form whatsoever.
  • Reuse, by making available to the public, all or a substantial part of the content of this database.
  • Use robots, spiders, crawlers, scripts or any other automated process to access, copy, or extract trek, plant, mushroom and reading data from the platform for the purpose of creating a competing database, resale or any other commercial or non-commercial exploitation.

Any violation of these rules will result in the immediate suspension of the User's account and may be subject to legal proceedings.

6. Service availability

The site is provided "as is". The publisher does not guarantee 100% uptime (maintenance, Supabase outage, etc.) and cannot be held responsible for any data loss. We advise you to keep a copy of your GPX files and photos.

7. Minimum age

Use of WalkAboutWild and account creation are reserved for persons aged at least 15 years. Minors must have the authorization of their legal representatives.

8. Modification of TOS

The publisher reserves the right to modify these TOS at any time. Users will be informed of significant changes by email or via a notification on the application.

9. Applicable law and jurisdiction

These TOS are subject to French law. In the event of a dispute, and failing an amicable agreement, French courts shall have sole jurisdiction.
